Part 1: Driving with a Disability

Are there any laws or regulations in your country that restrict whether people with disabilities can obtain a driving license?

No, Relevant legal framework regarding the non-restriction. According to Article 13, paragraph (4) of the Internal Affairs Ministry Order No. 268 dated December 8, 2010, on the examination procedure for obtaining a driving license, “candidates with physical disabilities will take the exam using vehicles adapted to their disability”. At the same time, the necessary logistical means for the practical test of the examination will be provided by the driving school where the candidate's training courses were conducted, or may be provided by the candidates themselves, in the case they have physical disabilities.

 

As regards the conditions to be met by a vehicle in order to be driven on public roads in Romania, the relevant legal provisions are Article 10 paragraph (1) of the Government Emergency Ordinance No. 195/2002 on traffic on public roads, according to which “the traffic on public roads is prohibited for those vehicles that do not correspond from a technical point of view, for those which are not obligatory ensured with a civil liability insurance for damages caused by traffic accidents to third parties, for those whose registration has been suspended, as well as for the registered vehicles whose term of validity for the periodic technical inspection is expired or canceled”.

 

Concerning the motor vehicles, agricultural or forestry tractors and trailers registered in other states, according to the provisions of Article 82 paragraph (3) of the same GEO, these “may circulate on the public roads in Romania, if they meet the technical conditions provided in the Convention on Road Traffic, concluded in Vienna on November 8, 1968 and ratified by Romania by Decree No. 318/1980, but only during the valid period of their the civil liability insurance for damages caused by motor vehicle accidents ”.

Are there any restrictions on the type of vehicle or adaptation to controls that can be driven by a person with a disability?

No, the Romanian road legislation is aligned to the EU legislation in this field. As such, no obligations or restrictions are imposed as regards the adaptation of vehicles to the disabilities of the driver

Are there minimum dimensions for the size of a parking space reserved for a person with a disability?

Yes, The legal framework is the Order no 189 of February 12, 2013 of the Ministry for Regional Development and public Administration, which establishes that: parking spaces reserved for the persons with disabilities are located as close as possible to the main entrances to buildings or areas of interest, less than 50 meters from them. The Order also stipulates the minimum dimensions for the size of a parking space reserved for persons with disabilities.

 

The size of the parking space reserved for wheelchair users is 3.70 x 5.40 m The parking spaces will be placed in packages of two places, a parking space measuring 2.50 x 5.40 m for the vehicle and a lane with a width of 1.20 m will be provided between the two places to ensure the transfer and movement of the person who uses a wheelchair.

Part 3: Hiring a car if you have a disability

Does your country have any laws which require hire car companies to make adapted vehicles available for people with disabilities to rent?

Where are such vehicles available? 

Relevant information about Romania's special legal framework on this subject , namely the Law no 448/2006 on the Protection of Persons with Disabilities : This law contains provisions referring to accessibility . Currently , the law stipulates only for the taxi operators, an obligation to ensure he at least one car adapted to the transport of disabled people. who use wheelchairs. The competent authority , which is the National Authority for the Protection of Disabled Persons, Children and Adoption (subordinated to the Ministry of Labor and Social Protection) considers the introduction of future amendments to the law concerning the facilities for disabled motorists via the hire car companies and services.
