Part 2: Parking cards for people with disability
Does your country have a national scheme of parking concessions for people with a disabilitiy?
Yes, Article 156 of the regulations to Law 7600 defines Responsible Authorities. The determination and regulation of reserved parking lots will be in charge of the Ministry of Public Works and Transport, appointing for this purpose the Vice Minister of Land Transport and Road Safety, who, through the corresponding body or organizational unit, will oversee both the obligation to establish reserved parking lots or preferential use, public and private; as well as the guarantee of access of the vehicles of people with disabilities or that transport them, to these parking lots, according to article 157 of Executive Decree 26831 of March 23, 1998 Regulation of the Law Equal opportunities for people with disabilities.
For this end:
1) The rector in disability National Council of People with Disabilities (Conapdis), will issue the respective identification that facilitates the use of these parking lots for people with disabilities who, due to a physical, intellectual, psychosocial or sensory deficiency, face limitations for the displacement and/or mobility. And it must be accepted by any authority.
2) The parking administration will ensure that the reserved parking spaces are not occupied by other people who are not authorized, according to article 96 of Law No. 9078 of the Law of traffic on public roads, land and road safety of October 04, 2012.
3) The control for improper use of these parking spaces will be in charge of the General Directorate of the Traffic Police of the Ministry of Public Works and Transportation. The fine contemplated in article 96 of Law No. 9078, relative to a category C fine, must be applied. To guarantee respect for the signage of reserved or preferential use parking lots, they may rely on the municipal police where it exists, and other figures. of support, in accordance with the provisions of Chapter I of Title VI of Law No. 9078 Law of traffic on public roads, land and road safety of October 4, 2012.

Are there minimum dimensions for the size of a parking space reserved for a person with a disability?
Yes, article 155 of Law 7600 defines the characteristics of reserved parking spaces. These must necessarily comply with the following technical accessibility characteristics:
- Width 3.30 meters. for 5.00 meters long (minimum).
- Areas built in a non-slip.
- With a ramp or curb that allows access to the sidewalk that leads to the main entrance.
For signage at a horizontal level (at floor level), the international access symbol must be placed in the center of the parking space, with dimensions of one meter by one meter, respecting the proportion and chromatic arrangement of the blue background and figure white.
Regarding vertical signage, every two adjoining spaces must have a sign placed at a minimum height of 2, 20 free meters, so that it does not hinder pedestrian traffic on the sidewalk or invade the ford or entrance ramp. This type of label must be composed of the letter "E" in capital letters, inscribed within a circle with a red line and a white center, below it the word "RESERVED" and in the lower part, the international access symbol with dimensions of 20 centimeters by 20 centimeters, as established in article 106 of this Regulation.

¿Hay leyes o reglamentos en su país que restrinjan si las personas con discapacidad pueden obtener una licencia de conducir?
Sí, las personas con alguna discapacidad pueden obtener una licencia de conducir, según lo estipulado en la Ley N.º 7600, Ley de Igualdad de Oportunidades para las Personas con Discapacidad, de 2 de mayo de 1996, y sus reformas, su reglamento y su interpretación, con base en los instrumentos internacionales sobre la materia ratificados por el país.
Si, el articulo 79 Derecho a obtención de la licencia de conducir, de la ley 9078 Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, establece que toda persona podrá obtener la licencia para la conducción de vehículos por vías públicas terrestres, una vez cumplidos los requisitos de idoneidad establecidos legal y reglamentariamente.
Las personas con discapacidad, que así lo requieran, podrán conducir vehículos especialmente adaptados, de conformidad con las mejores prácticas internacionales de seguridad vial y de derechos humanos.
Personas mayores de edad, con discapacidad intelectual, mental y psicosocial: Deberán acudir a realizar el trámite en compañía de su garante, debidamente acreditado. En caso de que no exista un dictamen médico que declare la discapacidad, pero que ésta sea evidente y manifiesta, el usuario deberá acudir a realizar la solicitud de salvaguardia, para que se nombre el garante.

Parte 2: Tarjetas de estacionamiento para personas con discapacidad
¿Cuenta su país con un esquema nacional de concesiones de estacionamiento para personas con discapacidad?
Sí, el Artículo 156 del reglamento a la ley 7600 define Autoridades Responsables. La determinación y regulación de los estacionamientos reservados, estará a cargo del Ministerio de Obras Públicas y Transportes, designándose para este efecto al Viceministro de Transporte Terrestre y Seguridad Vial, quien mediante el órgano o unidad organizativa correspondiente, fiscalizará tanto la obligación de que se establezcan estacionamientos reservados o de uso preferencial, públicos y privados; así como la garantía de acceso de los vehículos de personas con discapacidad o que les transporten, a estos estacionamientos, según el artículo 157 del Decreto Ejecutivo 26831 del 23 de marzo de 1998 Reglamento de la Ley Igualdad de oportunidades para las personas con discapacidad.
Para este fin:
1) El rector en discapacidad Consejo Nacional de Personas con Discapacidad (Conapdis), emitirá la respectiva identificación que facilite el uso de estos parqueos para las personas con discapacidad que en virtud de una deficiencia física, intelectual, sicosocial o sensorial, enfrenten limitaciones para el desplazamiento y o la movilidad. Y la misma deberá ser aceptada por cualquier autoridad.
2) La administración del parqueo velará porque los estacionamientos reservados no sean ocupados por otras personas que no estén autorizadas, según el artículo 96 de la Ley Nº9078 de Ley de tránsito por vías públicas, terrestres y seguridad vial del 04 de octubre del 2012.
3) El control por uso indebido de estos lugares de estacionamiento estará a cargo de la Dirección General de la Policía de Tránsito del Ministerio de Obras Públicas y Transportes. Debiendo aplicarse la multa contemplada en el artículo 96 de la ley Nº9078, relativa a una multa categoría C. Para garantizar el respeto a la señalización de los parqueos de uso reservado o preferencial, podrán apoyarse en la policía municipal donde exista, y de otras figuras de apoyo, de acuerdo a lo establecido en el Capítulo I del Título VI de la Ley Nº 9078 Ley de tránsito por vías públicas, terrestres y seguridad vial del 04 de octubre del 2012.
¿Qué categorías de personas con discapacidad son elegibles para la tarjeta de estacionamiento?
Toda persona con discapacidad que haya sido evaluada y autorizada por el CONAPDIS para aplicar a licencia de conducir puede solicitar la placa con el distintivo de persona con discapacidad y tener derecho al estacionamiento.
¿Hay plazas de aparcamiento reservadas para personas con discapacidad?
Si, según el art. 154 de la ley 7600: todo estacionamiento público y privado de atención al público, de acuerdo a lo que disponga de espacios para estacionar vehículos automotores, deberá disponer de espacios destinados a vehículos conducidos por personas con discapacidad o que les transporten.

Estos estacionamientos reservados deberán ubicarse en las entradas principales de los locales de atención al público, debidamente identificados con el símbolo internacional de acceso al que se hace referencia en el artículo 105 de este Reglamento.

Si, el artículo 155 de la ley 7600 define las características de los estacionamientos reservados. Estos necesariamente deberán cumplir con las siguientes características técnicas de accesibilidad:
- Anchura 3.30 mts. por 5.00 mts. de largo (mínimo).
- Zonas construidas en forma antiderrapante.
- Con rampa o bordillo que permita acceso a la acera que conduce a la entrada principal.
Para señalización a nivel horizontal (a nivel de piso), se debe colocar en el centro del espacio para el estacionamiento, el símbolo internacional de acceso, con dimensiones de un metro por un metro, respetando la proporción y disposición cromática de fondo azul y figura blanca.
En cuanto a rotulación vertical, cada dos espacios contiguos, se debe disponer de un rótulo colocado a una altura mínima de 2, 20 metros libres, de manera que no obstaculice el tránsito peatonal sobre la acera ni invada el vado o rampa de ingreso. Este tipo de rótulo debe estar compuesto por la letra "E" en mayúscula, inscrita dentro de un círculo con línea roja y centro blanco, debajo de ésta la palabra "RESERVADO" y en la parte inferior, el símbolo internacional de acceso con dimensiones de 20 centímetros por 20 centímetros, tal y como lo establece el artículo 106 de este Reglamento.
