Part 1: Driving with a Disability

Are there any laws or regulations in your country that restrict whether people with disabilities can obtain a driving licence?

Yes, people with disabilities can obtain driving non-professional driving licenses, they obtain the document with the restriction to drive only one car. This car has to have all the adaptations that the person will need for safe driving. Furthermore, one of the tests to obtain the driving license is a medical test, which is regulated by Supreme Decree N°170 of 1985, Ministry of Transport and Telecommunication.

This test evaluates all driver’s license applicants and it does not have specific items or criteria for people with disabilities. The medical test is composed by three parts. One of them consists in a medical interview, in which de doctor asks questions in order to get to know the medical history of the applicant. Another part is composed by a test that evaluates both coordination and reaction skills. The third part implies comparing vision and audition levels with the criteria from the Supreme Decree N°170 of 1985. It is important to mention that none of these exams have adaptations that can be used by a person with disability to carry out the test.

Are there restrictions on the type of vehicle or adaptation to controls that can be driven by a person with a disability?

No, even though there are no regulations about the type of vehicle or adaptation to controls, the doctor in charge of the examination has to indicate in a form which vehicle could be driven by the person, or the adaptations the car must have.

Do the same restrictions apply to a person with a disability visiting your country in their own or a rented vehicle? Please give details.

Part 2: Parking Cards for people with a disability

All people registered in the National Disability Registry that have an identification card that accredits his/her condition are eligible. This registry is managed by the country’s Civil Registry Service, and it has all the records of all people who have been certified with some disability by the Preventive Medicine and Disability Commissions (COMPIN in Spanish) and that have expressed their will to be included on this registry. To determine if a person has a disability (any type of disability) they must go through a process in their respective Preventive Medicine and Disability Commission, and once this Commission reviews medical records and reports, the disability is certified and that person can be included in the National Disability Registry.

All the spaces above plus commercial establishments, industrial and services areas, whether they are public or private; also those that hold artistic, cultural or sport events; all buildings destined to any use that implies the attendance of public, and spaces of public use. Also in apartment buildings, there is a required amount of reserved parking spaces based on the total number of spaces built, as well as a at least one reserved parking space for visitors.
