Part 1: Driving with a Disability

Are there any laws or regulations in your country that restrict whether people with disabilities can obtain a driving licence?

Yes, the Rulebook on the motor vehicles drivers training (Official Gazette of BiH, 46/12) stipulates that the people with disabilities may receive the training to drive motor vehicles taking place either in their personal vehicles or rented vehicles, provided that the necessary aids are used throughout the training, such as automatic gear shift or a vehicle specially adapted to their physical disabilities determined as such in the medical certificate.

 

The vehicles used for training of persons with disabilities shall be marked with a white 400 x 150 mm plate stating “TRAINING” in blue. Furthermore, the Rulebook on the procedure and requirements for conducting motor vehicle driver test (Official Gazette of BiH, 46/12) stipulates that people with disabilities may take driving tests in vehicles specially adapted to their individual physical disabilities, provided that special aids are used throughout the test (glasses, prosthesis etc.) and the test is taking place in their personal or rented vehicles equipped with the automatic gear shift.

Are there restrictions on the type of vehicle or adaptation to controls that can be driven by a person with a disability?

Yes, The Rulebook on driving licence (Official Gazette of BiH, 26/19) stipulates that a driving licence may  be granted to a person with a disability or physical defects which pose no obstacle to driving a motor vehicle, but make it much more difficult. However, a driver is entitled to drive a motor vehicle only if he/she uses aids indicated in the column “Remarks“ on the back of the driving licence, such as “glasses“, “hearing aids“ and “otrhopedic aids“.

 

The codes “01”, “02” and “03” are assigned to “glasses“, “hearing aids“ and “orthopedic aids“, respectively, and entered into the driving licence accordingly.

 

In case a driving licence is valid, and a holder of the driving licence becomes required to use glasses, orthopedic aids and/or a hearing aid, he/she must submit an application for replacement driving licence on a proper form within 15 days from the day of the occurrence of such requirement.

 

The following terms have the following meanings:

“glasses” means the use of glasses or lenses when driving

“orthopedic aids” means the use of prosthesis and that motor vehicles are adapted to the needs of people with disabilities,

“hearing aids” means the use of hearing aids. Individuals who had their driver training and took their driver test in the vehicle equipped with the automatic gear shift, shall have the “automatic transmission“ and code “10.02“ indicated in the column “Remarks“ of their driving licences.

Part 2: Parking Cards for people with a disability

Does your country have a national scheme of parking concessions for people with a disability?

Yes, the Rulebook on marking the vehicles operated by persons with damaged extremities or used to transport persons with 100% disability rating (Official Gazette of BIH, 54,17), stipulates the manner and procedure for marking the vehicles operated by persons with damaged extremities or used to transport persons with 100% disability rating or members of the Association of persons with disability, the appearance of the symbol used to mark such vehicles, the procedure for issuing the symbol, placement and usage of the symbol, the symbol validity period and record keeping. A symbol of accessibility is an international symbol used to mark a vehicle operated by a person with damaged extremities or used to transport a person with a 100% disability rating or the association members.

Which categories of people with a disability are eligible for the parking card?

Persons with damaged extremities. Persons with 100% disability rating. Association of people with 100% disability rating used to transport the members of the said Association A symbol of accessibility shall be issued to the applicant with respect to the vehicle which:

a) is operated by a person with damaged extremities,

b) is used to transport persons with 100% disability rating,

c) is in possession of the Association of people with 100% disability rating, and used to transport the members of the said Association. A symbol of accessibility shall be issued for a period of 10 years.

Are there parking spaces reserved for people with a disability?

Where are the reserved parking spaces?

A vehicle displaying a symbol of accessibility may be parked in any parking space reserved for persons with disabilities and marked accordingly

What concessions does the parking card give people with a disability?

Please note that the use of car parks by an individual who has been granted symbol of accessibility falls under the competence of Cantons, Cities and local administration units. With regard to the use of car parks by persons with a disability, please see below an excerpt from the Regulation on parking scheme, public car parks, parking zones, new car parks construction, and the uniform parking payment system adopted by the Government of the Sarajevo Canton:

(1) In public paid car parks, persons with a disability may park their vehicles, which must display a valid symbol of accessibility, in the specifically marked bays reserved for such persons free of charge for up to three hours, after that time they are required to pay a parking card in accordance with this Regulation.

(2) Persons with a disability are required to pay a parking charge provided for in this Regulation if they park their vehicles displaying international symbol of accessibility in the paid parking bay which is not intended and marked for persons with a disability.

(3) The number and arrangement of the marked parking bays for persons with a disability shall be determined by the Ministry with respect to each public on-street car park applying the ratio of up to 5% of the overall number of the available parking bays.

(4) The competent municipality shall obtain approval of the Ministry of Traffic of the Sarajevo Canton to mark parking bays for persons with a disability at locations not designated as public paid car parks.

(5) The organisers of public, cultural and sports events are required to provide parking spaces for the persons with disabilities as close as possible to the event site.

(6) Persons with disabilities holding a valid symbol of accessibility may park in the ramp car parks having the parking bays marked for the use of disabled persons, and provided that there is a signage displayed at the entrance to the car park showing that the persons with disability may park their vehicles in specially marked parking bays.

(7) Persons with disabilities may park as provided for in paragraph 6 of this Article for up to three hours, after that time they are required to pay parking charges in accordance with this Regulation.
